• Payment & Billing Information: necessary to process payments for our services. All payment transactions are securely handled by trusted third-party payment processors (e.g., PayHere). We do not store your card details on our servers.
• Browsing Information: such as your IP address, browser type, and device information, collected automatically through cookies and similar technologies.
• Project & Communication Data: any files, messages, or requirements you share with us during the course of a project.

2. How We Use Your Information

• To respond to your enquiries and deliver the services you requested.
• To process payments and send invoices or receipts.
• To improve our website experience and service quality.
• To send project updates, notifications, or promotional offers (you can opt out at any time).
• To comply with applicable laws and legal obligations.

3. Sharing of Information

We respect your privacy and do not sell, trade, or transfer your personal information to third parties without your consent, except in the following circumstances:

• Trusted Service Providers: such as hosting companies, payment processors, and analytics tools, who are contractually obligated to handle your data securely.
• Legal Requirements: if required to do so by law or in response to valid legal requests.

4. The "Start a project" form

When you send the form we store what you enter (name, email, optional phone and country, the service, budget and timeline you pick, your message and any links), the page you sent it from, the time, and your IP address and browser type. The IP address and browser type are used only to stop spam and abuse.

• Why: to reply to your enquiry and prepare a quote. You agree to this by ticking the box on the form.
• Who sees it: only BN Softlabs. It is stored on our hosting provider's servers and sent to our business email. A confirmation email is sent to the address you give.
• How long: enquiries that do not become a project are deleted within 12 months. Project correspondence is kept for as long as needed for the project and for legal and accounting purposes.
• Your choice: email [email protected] at any time to see, correct or delete what we hold about you.

5. Cookies

Cookies are small files stored on your device. This website uses them as follows:

• Always on (needed for the site to work): a session cookie and a security (CSRF) cookie used when you send the contact form. Your theme choice (light or dark) and your cookie choice are saved in your browser's local storage.
• Only if you click "Accept": Google Analytics through Google Tag Manager (which pages are visited and how the site is used) and the Meta Pixel (to measure our Facebook and Instagram ads). Until you accept, Google tools run in a cookieless mode and the Meta Pixel is not loaded at all.
• Only if you open it: the live chat (Landbot) and the call scheduler (Calendly) load, and may set their own cookies, only after you click "Chat now" or "Book a call".

You can change your choice at any time with the Cookie settings link at the bottom of every page, or block cookies in your browser settings.

6. Data Security

We implement industry-standard security measures, including SSL encryption, to protect your personal information from unauthorized access, alteration, disclosure, or destruction. However, no method of internet transmission or electronic storage is 100% secure, and we cannot guarantee absolute security.

1. General Policy

Due to the custom and digital nature of our services (web design, software development, mobile apps, etc.), all sales are generally considered final once work has commenced. However, we are committed to resolving any issues fairly and professionally.

2. Eligibility for Refund

Refunds may be considered under the following circumstances:

• Project Not Started: If you cancel your order before any work has begun, you are entitled to a full refund of any deposit paid.
• Partial Completion: If work has commenced but you wish to cancel, a partial refund may be issued based on the percentage of work completed at the time of cancellation.
• Failure to Deliver: If we are unable to deliver the agreed service within the agreed timeframe (due to reasons on our end), you may be eligible for a full or partial refund.
• Major Defects: If the delivered product contains critical, unrepairable defects that significantly deviate from the agreed project scope, a refund request may be considered.

3. Non-Refundable Items

• Work already completed and approved by the client.
• Third-party costs (domain registration, hosting, licenses, stock assets) paid on your behalf.
• Rush or priority service fees.
• Consultation or discovery fees.
• Completed digital products (scripts, themes, plugins) once delivered and activated.

4. Refund Request Process

• Submit your refund request via email to [email protected] within 14 days of the issue arising.
• Include your project details, reason for the request, and any supporting evidence.
• We will review your request and respond within 5 business days.
• If approved, refunds will be processed to your original payment method within 7–14 business days.

5. Dispute Resolution

We always prefer to resolve disputes amicably. If you are dissatisfied with the outcome of your refund request, please contact us directly to discuss further. We reserve the right to make the final decision on all refund requests in accordance with this policy.

Terms & Conditions

This User Agreement ("Agreement") is a contract between you ("Client") and BN Softlabs ("we", "us", or "our") that governs your access to and use of our website and services. By accessing our website or engaging our services, you agree to be bound by these Terms & Conditions.

1. Services

BN Softlabs provides custom web development, software development, mobile application development, UI/UX design, game development, and digital marketing services. All services are subject to a separate project agreement or service proposal outlining scope, deliverables, timeline, and payment terms.

2. Acceptable Use

You agree not to use our website or services to:

• Violate any applicable local, national, or international law or regulation.
• Transmit any unsolicited or unauthorised advertising or promotional material.
• Engage in any fraudulent, deceptive, or misleading conduct.
• Infringe upon any third party's intellectual property, privacy, or other rights.
• Distribute malware, viruses, or any other harmful code.
• Request development of illegal, harmful, or unethical software or content.

3. Intellectual Property

• All content on this website, including but not limited to text, images, logos, and graphics, is the intellectual property of BN Softlabs or its licensors.
• You may not reproduce, distribute, or modify any content without prior written consent.
• Upon full payment for a completed project, ownership of the custom-built deliverables is transferred to the client, unless otherwise stated in the project agreement.
• We reserve the right to display completed work in our portfolio unless explicitly agreed otherwise in writing.

4. Payments

• A deposit (typically 50% of the project value) is required before work commences.
• The remaining balance is due upon project completion, before final files are delivered.
• Payments are processed securely via PayHere or agreed payment channels.
• Late payments may result in suspension of work until the outstanding amount is settled.
• All prices are quoted in USD unless otherwise stated.

5. Project Timelines

Estimated timelines are provided in good faith and are subject to change based on client responsiveness, scope changes, and other factors. Delays caused by late feedback, change requests, or failure to provide required materials by the client will not be our responsibility.

6. Limitation of Liability

To the fullest extent permitted by law:

• BN Softlabs shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our website or services.
• We make no warranties, express or implied, regarding the suitability, reliability, or accuracy of our services for any particular purpose.
• Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

7. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of a project. We will not disclose your business information, project details, or data to third parties without your consent, except where required by law.

8. Termination

Either party may terminate a project agreement with written notice. In the event of termination, the client is liable for payment for all work completed up to the termination date. We reserve the right to terminate our services immediately if a client is found to be in breach of these Terms.

9. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

10. Changes to Terms
